Unregistered barrister Waheed Ur Rehman Mian is prevented from applying for a practising certificate for nine months by an independent disciplinary tribunal, which concluded on 14 July 2026, following four charges of professional misconduct brought by the Bar Standards Board (BSB).
The tribunal found that Mr Mian behaved in a way which is likely to diminish the trust and confidence that the public places in him or in the profession and could reasonably be seen by the public to undermine his integrity. The charges arise from Mr Mian’s finding at the Solicitors’ Disciplinary Tribunal (SDT) in February 2025 where Mr Mian failed to disclose to clients, investing in proposed development projects, that he and his law firm had a relevant connection or interest in businesses involved in development projects. Mr Mian therefore allowed the law firm to represent clients in circumstances where he knew, or ought to have known that there was a significant risk of a conflict of interest.
The tribunal also found, as did the SDT, that Mr Mian failed to adequately advise clients involved in the development projects of the risks in such investment schemes and failed to ensure they fully understood those risks. He also failed to ensure clients were informed about issues relating to obtaining planning permission for the proposed development projects, prior to releasing client funds to a property development company. Mr Mian also failed to provide supervision to a junior staff member of the law firm who was representing clients in relation to the proposed development projects.
A BSB spokesperson said:
“The conduct of Mr Mian fell below the high standards reasonably expected of barristers when providing legal services, including where they are authorised by another approved regulator. There was a significant risk of a conflict of interest when failing to disclose to clients investing that he and his law firm had a connection or interest in the business involved. The decision to prevent Mr Mian applying for a practising certificate reflects the seriousness of the misconduct in this case.”
The tribunal’s findings remain subject to appeal.
