Unregistered barrister Mark Peter Giles was ordered to be suspended from practice for six months by an independent disciplinary tribunal which concluded on 18 October 2023 following a finding of professional misconduct brought by the Bar Standards Board (BSB). The effect is that Mr Giles cannot practise as a barrister until the end of the suspension period.
The tribunal found that Mr Giles behaved in a way which was likely to diminish the trust and confidence which the public places in him or in the profession, in that he was sentenced to a 12-month Community Order for having assaulted another person, contrary to s39 of the Criminal Justice Act 1988.
Commenting on the order, a BSB spokesperson said: “Assault is a serious matter and the tribunal’s decision to suspend Mr Giles from practice reflects this. Such conduct is likely to diminish the trust and confidence which the public places in him or in the profession.”
The tribunal’s decision is open to appeal.

The Bar Tribunals and Adjudication Service (BTAS) is responsible for appointing and administering Disciplinary Tribunals on behalf of the President of the Council of the Inns of Court and its tribunals are independent of the BSB. The BSB is responsible for bringing charges of professional misconduct against barristers, which BTAS tribunal panels then adjudicate.
