Barrister Emma Elizabeth Smith was ordered to be disbarred by an independent disciplinary tribunal on 8 April following a finding on three charges of professional misconduct brought by the Bar Standards Board (BSB).

The tribunal found that Ms Smith had acted dishonestly during a hearing before the Family Court in June 2024. At that hearing Ms Smith advanced an application for a child to be permitted to change nursery when she knew the child had already changed nursery.

Ms Smith admitted all three charges of dishonesty, misleading the court, and failing to observe her duty to the Court in the administration of Justice.

Spokesperson, The Bar Standards Board said: 

“Dishonesty before the courts is incompatible with the standards that the public and profession expect of the Bar of England and Wales. The Tribunal’s decision to disbar reflects the seriousness of her actions.”

Emma Elizabeth Smith was called to the Bar by Lincoln’s Inn in October 2005. The tribunal’s findings remain subject to appeal.
