Offence details:

John Idowu Benedict practised as a barrister from 1 February 2006 until 6 November 2006 without having a practising certificate issued by the Bar Council, contrary to paragraph 202(c) and Annexe D (The Practising Certificate Regulations) of the Code of Conduct and, having been informed of the need to obtain a practising certificate by letter dated 6 February 2006, failed to take the necessary actions to cure the non-compliance.

John Idowu Benedict, having been given 28 days to pay a financial penalty of ?100 imposed on him on 27 September 2006 in accordance with paragraph 901.1, failed to pay the said financial penalty by the due date of 25 October 2006.

John Idowu Benedict failed to respond promptly to requests from the Bar Standards Board for comments or information on a complaint, in that he failed to respond to letters sent to him by the Bar Standards Board dated 2 and 28 November 2006 and 26 February 2007 and such failure being, by virtue of its combination with other failures to comply with the Code (being the failures which are the subject of Charges 1 and 2 above), so serious as to be likely to bring the Bar into disrepute.

John Idowu Benedict practised as a barrister having failed to complete the prescribed 12 hours Continuing Professional Development for the Established Practitioners Programme and/or return a completed record card by 31 January 2006, contrary to the requirements of paragraph 202(b) and Annex C (Continuing Professional Development Regulations) of the Code of Conduct and, having been informed of the need to complete the hours by letter dated 20 February 2006, failed to take the necessary actions to cure the non-compliance.

John Idowu Benedict, having been given 28 days to pay a financial penalty of ?100 imposed on him on 17 October 2006 in accordance with paragraph 901.1, failed to pay the said financial penalty by the due date of 14 November 2006.

John Idowu Benedict failed to respond promptly to requests from the Bar Standards Board for comments or information on a complaint, in that he failed to respond to letters sent to him by the Bar Standards Board dated 10 January 2007 and 12 April 2007, such failure being, by virtue of its combination with other failures to comply with the Code (being the failures which are the subject of Charges 1 and 2 above), so serious as to be likely to bring the Bar into disrepute.

Sanction:
1. Suspended for 2 months. 2. In respect of Charge 1 (D 07/078) further suspension for 1 month, unless outstanding CPD has been completed and CPD record returned by end of 2 month suspension period. 3. Failure to comply with 1 & 2 above, disbarred. 4. If outstanding £200 is not paid , suspension to run concurrent with paragraph 2 or until payment of sum due.
