Offence details:

John George Bernatt on 13 January 1987 engaged in conduct which was dishonest or otherwise discreditable to a barrister in that, being a Partner of the firm Messrs Bernatt Pereira & Co, Advocates and Solicitors, Kuala Lumpar, Malaysia, he appeared in the High Court of Malaysia and obtained an Order for the payment of RM 51,473.50 into the client account of Messrs Bernatt Pereira & Co. He did so without having the authority of Teik Seng Realty Sdn Bhd and/or Yap Ham Chiam and thus has no right to request the High Court to pay the money into the said solicitors account, for which conduct he was struck off the Roll of Advocates and Solicitors of the High Court of Malaya at a Disciplinary Committee Hearing on 17 January 2003.

John George Bernatt between 13 January 1987 and 30 September 2002 engaged in conduct which was dishonest or otherwise discreditable to a barrister in that, being a Partner of the firm Messrs Bernatt Pereira & Co, Advocates and Solicitors, Kuala Lumpar, Malaysia, he received a sum of money into the client account of Messrs Bernatt Pereira & Co pursuant to a Court Order dated 13 January 1987 which by the terms of that Order the money was payable to the plaintiff stated in the Order. He failed to pay that money to the plaintiff, for which conduct he was struck off the Roll of Advocates and Solicitors of the High Court of Malaya at a Disciplinary Committee Hearing on 17 January 2003.

John George Bernatt on divers dates between 30 September 1999 and 13 October 2000 engaged in conduct which was discreditable to a barrister in that, being a Partner of the firm Messrs Bernatt Pereira & Co, Advocates and Solicitors, Kuala Lumpar, Malaysia, he sought by letter to make it a condition of acceptance of a cheque on 1 October 1999 and/or settlement in full on 3 November 1999 and/or 12 October 2000 that the parties seeking payment withdraw their police report and the complaint to the Bar Council of Malaysia, for which conduct he was struck off the Roll of Advocates and Solicitors of the High Court of Malaya at a Disciplinary Committee Hearing on 17 January 2003.
