Offence details:

Rosa Zaffuto, a practising barrister, in relation to fees charged for work undertaken on behalf of Person B between 23 August 2017 and 6 December 2017 of £420,000 plus VAT and as set out in the fee note issued and presented to Person B on or around 6 December 2017, Ms. Zaffuto:

a) Did not, as required by rC88.1, keep any or any adequate records supporting the fees charged or claimed for the work undertaken when at the relevant time the fees had not been paid and there had not been any determination or assessment of costs in relation to those fees; and/or
b) In engaging in the conduct in a) above, behaved in a way which is likely to diminish trust and confidence which the public places in her or in the profession.

Rosa Zaffuto, a practising barrister, did not respond to a letter dated 2 May 2018 from Statutory Law Limited, instructed by Person B, in which Statutory Law Limited sought further information and documentation regarding the work undertaken by Ms Zaffuto on behalf of Person B between 23 August 2017 and 6 December 2017 and which was presented to Person B in a fee note dated 6 December 2017. In failing to respond Ms. Zaffuto:

a) Did not, as required by rC88.2, provide Person B with such records or details of the work she had done as may be reasonably be required for the purposes of verifying the fee note of 6 December 2017; and/or
b) In engaging in the conduct in a) above, behaved in a way which is likely to diminish trust and confidence which the public places in her or in the profession.

Sanction:
Fined in the sum of £5000 and ordered to undertake a public access course for barristers by 31 December 2022
