Offence details:

Iain Leadbetter practised as a barrister and carried out reserved legal activities between 1 May 2013 and 31 December 2013 without having a practising certificate issued by the Bar Council contrary to paragraph 202 (c) of the Code of Conduct and the Practising Certificate Regulations (Annex D of the Code of Conduct). This failure was serious and therefore constitutes professional misconduct pursuant to paragraph 901.5 of the Code of Conduct by virtue of its nature and extent and the fact that it constitutes a criminal offence pursuant to section 14 of the Legal Services Act 2007 and by virtue of failures by Mr Leadbetter to comply with other provisions the Code of Conduct, namely paragraph 202(b) in respect of his 2009 and 2010 CPD requirements and paragraph 402.2 in relation to his BMIF insurance.

Iain Leadbetter failed to provide promptly all such information to the Bar Standards Board when required to do so, in that he failed to respond to letters sent to him by the Bar Standards Board dated 29 January 2014, 14 February 2014 and 4 March 2014, such failure being serious as to amount to professional misconduct, given its combination with a failure to comply with the Code of Conduct (8th Edition) (being the failure which is the subject of Charge 1 of this Charge Sheet) and by virtue of a previous failure by Iain Leadbetter to provide promptly information requested by the Bar Standards Board in 2011.
