The Visitors to the Inns of Court handed down the approved judgment on 20 January 2012 in respect of an appeal by David Leathley against the finding of a disciplinary tribunal on 17 November 2008. The grounds of appeal were against the decision of the tribunal, and arguments were also advanced alleging apparent bias based on the fees and payment of the lay members who sat on that tribunal in 2008 and on the content of written guidance issued subsequently to panel members. There were further discrete arguments supporting the recusal of the non-judicial Visitors.
The appeal itself was dismissed and the Visitors rejected the arguments about apparent bias.
