a. To discharge the functions of the Bar Council and the Inns in respect of the recognition of European lawyers conferred upon them pursuant to the European Communities (Recognition of Professional Qualifications) Regulations 1991 and the European Communities (Lawyers' Practice) Regulations (2000).
b. To consider and determine: i. Applications by specially qualified applicants for admission to the Bar of England and Wales; ii. Applications for exemption from the examinations, practical exercises, pupillage and other like requirements of the Consolidated Regulations and of any regulations replacing them, including applications under CR 58 or its successor regulation, and the Code of Conduct; and iii. Requests for review from the exercise of discretions conferred by the Regulations on the Head of Education, Training and Records and on other administrative officers.
c. To consider and determine matters in respect of educational qualifications in applications for admission to an Inn of Court made by mature students falling within Category II(d) of Schedule 2 of the Consolidated Regulations.
d. To consider and determine all applications for waivers of the requirements of: i. Paragraphs 1102, 1104 and 1105 of the Code of Conduct (transitional provisions relating to rights of audience and qualified persons); ii. Paragraph 203.1(b) of the Code of Conduct (the "three year rule"); iii. Paragraph 203.3 of the Code of Conduct ("qualified person"); iv. Paragraph 204 (c) of the Code of Conduct (Public Access training); v. Paragraph 1(b) of the Employed Barristers' (Conduct of Litigation) Rules (exemption from the requirement of 12 weeks' supervised practice); vi. Any requirement of the Employed Barristers' (Conduct of Litigation) Rules. Paragraph 204(c)(i) and (ii) of the Code; vii. The requirements of the Continuing Professional Development Regulations (Code of Conduct, Annex C); viii. The pupillage funding and advertising requirements (Code of Conduct, Annex R); and ix. Any other rule of regulation including any matter delegated to it by the BSB.
e. To consider and determine matters under CR 47 ;
f. To consider and determine applications from EU practitioners to be designated as qualified persons for the purposes of the International Practice Rules;
g. To determine any request from an applicant for admission to an Inn to review that Inn's refusal of admission or any issue relating to admission referred to it by an Inn, and if considered appropriate to request the Inns' Council to convene a tribunal to determine any such review or matter;
h. To undertake such other tasks as may be delegated to it by the BSB:
i. To supervise and, where necessary, decide on the issue of practising certificates and pupil supervisor registrations;
j. To liaise, where appropriate, with the other regulatory committees, the representative committees and the Inns' Council in discharging its functions;
k. To report annually to the BSB on its work.
