Personal injury lawyers work in a business environment where opportunities seem to be contracting and in a speciality which other litigators tend to regard as reserved for the mentally challenged. When the downward drive on fees is added to the equation the inevitable question is: “Why do we do it?”



How can we play to our strengths and create possibilities for practice development and career satisfaction? Are there changes in legal practice or emerging categories of personal injury claims which may give rise to opportunities? Having spotted an opportunity firm backing is likely to be needed to take advantage of it. How can this be obtained?



The presentation will address these questions and cover the following areas:-



The personal injury marketplace – problems for claimants and problems for defendants including direct access and competition from barristers;

Update on mixed partnerships and the role of in house advocates;

Costs and profitability – risk assessments and conditional fees for defendants?

Employers' liability – stress harassment and bullying beat knee VDU conditions respiratory diseases acoustic shock industrial deafness. Any other areas?

Public liability – Human Rights Act and assault claims harassment aggravated damages asbestos mobile phones radio masts toxic mould. Any other areas?

The role of the claimant lawyer: rehabilitation as a buzz word and as a practical solution;

Achieving early resolution via mediation arbitration and settlement meetings;

Practice development plans: ambulance chasing advertising mailshots blogs lunches and who you know.
